 UK GDPR Privacy notice for employees, workers and subcontractors (UK)

 

WHAT IS THE PURPOSE OF THIS DOCUMENT?

 

Berry Recruitment Group Limited (BRGL)andthe companies within its group namely, Berry Recruitment Limited(including the Berry Recruitment Jobs App and BerryWorker App), Wild Recruitment Limited and Wild Recruitmentt/a First Recruitment Services (collectively referredto as ‘the Berry Recruitment Group’) are committed to protecting theprivacy and security of yourpersonal information.

 

This privacy notice describes how we collect and use personal information about you during and after you have providedservices to us, in accordance with the Retained Regulation (EU) 2016/679 (UK GDPR) and Data Protection Act 2018.

 

It applies to all employees, workers and subcontractors.

 

 

 

The Berry Recruitment Group is adata controller. This means that we are responsible for deciding how we holdanduse personal information about you.We are requiredunder data protection legislation to notify you oftheinformation containedin this privacy notice.

 

This notice applies to current and former employees, workers, subcontractors and candidates seeking permanent roleswith any BRGL clients.This notice also applies to Limited CompanyContractors that we engage with because we may holdandprocess personaldata or special categories of personal data for the Limited Company Contractor’s directors,employees, substitutes or hired assistants. References in this notice to youor your’ refer to the data of the individualsengaged by the LimitedCompany Contractor. This notice does not confer, imply or create any direct contractualrelationship between Berry Recruitment Group and any individual engaged or employed by the Limited Company Contractor.

 

This notice does not form part of any contract of employmentorother contract to provide services. We may update this notice at any time. For the avoidance of doubt, we are required by law to issue this notice to all individuals for which wehold personal data and the issuing of this notice does not alter the terms of any contractswe have agreed with you and does not alter the status under which we have contracted with you. For the avoidance of doubt the UK GDPR applies toall individuals regardless of their status and this privacy notice does not confer any employment or worker rights onto you, any rights and obligations that you may or may not haveare derivedfrom the contract you agreed withusand this notice does not form part ofthat contract.

 

It is important that you read this notice, together with any other privacy notice we may provide on specific occasions when we are collectingorprocessing personal information about you, so that you areaware of how andwhy we are using such information.

 

DATA PROTECTION PRINCIPLES

 

We will comply with data protection law. This says that the personal information we hold about you must be:

 

1. Used lawfully, fairly and in a transparent way.

 

2. Collected only for valid purposes that we have clearly explainedtoyou and not usedin any way that is incompatiblewith those purposes.

 

3. Relevant to the purposes we have told you about and limited only to those purposes.

 

4. Accurate and kept up to date.

 


5. Kept only as long as necessary for the purposes we have told you about.

 

6. Kept securely.

 

 

 

THE KIND OF INFORMATION WE HOLD ABOUT YOU*

 

Personal data, or personal information, means any information about an individual from which that person can beidentified. It does not include data where the identity hasbeen removed (anonymous data).

 

There are specialcategories” of more sensitive personal data which require a higher level of protection.

 

We may collect, store, and use the following categories of personal information about you:

 

       Personal contact details such as name, title, addresses, telephone numbers, and personal email addresses.

 

•            Date of birth.

 

•            National Insurance number.

 

•            Bank account details, payroll records and tax status information.

 

•            Salary, annual leave and pension information.

 

•            Start date.

 

•            Geolocation data (when confirmed for a shift on the Berry Recruitment Jobs or BerryWorker app).

 

•             Recruitment information (including copies of right to work documentation, referencesand other informationincluded in a CV or cover letter or as part of the application process).

 

•             Employment records  (including job  titles,  work  history, working  hours, training  records  and professionalmemberships).

 

•            Disciplinary and grievance information.

 

•            Information about your use of our information and communications systems.

 

We may also collect, store and use the following special categories of more sensitive personal information:

 

•            Information about your health, including any medical condition, health and sickness records.

 

•            Records from the DisclosureandBarring Service

 

*It should be noted that the above list areexamples of information we may haveconcerning you and it does not mean that we do hold this information on you. For example, if you are engaged under a contract for services by us we will nothold employment records or disciplinary and grievance informationabout you.

 

HOW IS YOUR PERSONAL INFORMATION COLLECTED?

 

We typically collect personal informationabout employees, workers and Sub-contractors throughthe application,recruitment or engagement process, either directly from individualsor viaour Berry Recruitment Jobsand BerryWorkerapps, sometimes fromour clientor background check provider. We may sometimes collect additional information from third parties including former employers, credit reference agencies or other background check agencies.We also collectyourinformation from CVlibraries andjob boards.

 

We will collect additional personal information in the course of the services you provide to us throughout the period of you provide services to us.


If, under the contract you have agreed with us you have the right to send a substitute or engage hired assistants,we may need to collect some personal information relating to the substitute/assistants you choose to send for health and safety purposes and to ensure the substitute/assistants has the necessaryskills and expertise to provide the services. Where this is the case we will notifyyou at the time.

 

HOW WE WILL USE INFORMATION ABOUT YOU

 

We will only use your personal information when the law allows us to. Most commonly, we will use your personalinformation in the following circumstances:

 

1. Where we need to perform the contract that we have entered intowith you. In order to perform our contract with youwe may contact you by post, telephone call, email or via the Berry Recruitment Job or BerryWorker App or any other electronic means.

 

2. Where we need to use social media platforms to find you suitable work.

 

3. Where we need to comply with a legal obligation.

 

4. Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rightsdonot override those interests.

 

We may also use your personal information in the following situations, which are likely to be rare:

 

1. Where we need to protect your interests (or someone else’s interests).

 

2. Where it is needed in the public interest or for official purposes.

 

 

 

Situations in which we will use yourpersonal information

 

We need all the categories of information in the list above primarily to allow us to:

 

•       perform our contract with you (including for us to determine your suitability for roles); and

 

•       to enable us to comply with legal obligations

 

•        In some cases we may use your personal information to pursue legitimate interests of our own or those of thirdparties, provided your interests and fundamental rights do not override those interests. The situations in which wewill process yourpersonal information are listed below.

 

We have indicated below the purpose or purposes forwhich we are processing orwill process your personal information,as well as indicating whichcategories ofdata are involved.

 

•            Determining the terms on which you work for us.

 

•             Through the Berry Recruitment Job or BerryWorker app we determine your location to establish that you are on your way to a booking (and to provide you with your estimates arrival time). Your geo-location data isalso used to confirm yourarrival to, attendance of and departure from a booking to ensure your worked hours arerecorded accurately and forthecorrect client location.

 

•            To obtain feedback from you on how our agreement with you has worked in practice

 

•            Checking you are legally entitled to work in the UK

 

•            Paying you and, if you are an employee, deductingtax and National Insurance contributions.

 

•            Liaising with your pension provider (if applicable)

 

•            Administering the contract we have entered into with you.


•            Making decisions about your continued employment or engagement.

 

•            Making arrangements for the termination of our contract with you.

 

•             Dealing withlegal disputes involving you,orother employees, workers and subcontractorincluding accidents at work.

 

•            Ascertaining your fitness to work.

 

•            Managing sickness absence

 

•            Complyingwith health and safetyobligations.

 

•            To prevent fraud.

 

•            To monitor your use of our information and communication systems to ensure compliance with our IT policies.

 

•             Toensure network and information security, including preventing unauthorised access to our computer andelectronic communications systemsand preventing malicioussoftware distribution.

 

•            To conduct data analytics studies to review and better understand employee retention and attrition rates.

 

•            Equal opportunities monitoring.

 

 

Some of the above grounds for processing will overlap and there may be several grounds which justify our use of your personalinformation.  For example, your personal information may berequired as part of a pre-employment screening process for your position (e.g. tocheck against regulatory sanctions or as part of a sector-based screeningprocess, such as the Baseline Personnel Security Standard (BPSS) for governmentworkers and contractors, which includes identify verification, right to work,employment history, and criminal record checks). 

 

It should be noted that the reasons listed above may not apply to all those we engage with. For example; if you are engaged under a contractfor services then we will not be using yourpersonal information for disciplinary or grievance matters.

 

If you fail to provide personal information

 

If you fail to provide certain information when requested, we may not be able to perform the contract we have entered into with you (such as paying you or providing a benefit), or we may be preventedfrom complying with our legal obligations (suchas to ensure the healthandsafety of our workers).

 

Change of purpose

 

We will only use yourpersonal information for the purposes for whichwecollected it, unless we reasonably consider thatwe need to use it for another reason and thatreason is compatiblewith the original purpose. If we need to use yourpersonal information for anunrelated purpose, we will notify you andwe will explain the legalbasis which allows us to doso.

 

Please note that we may process your personal information without your knowledge or consent, in compliance with theabove rules, where this is required or permitted by law.

 

 

HOW WE USE PARTICULARLY SENSITIVE PERSONAL INFORMATION

 

Special categories of particularly sensitive personalinformation require higher levels of protection. We need to havefurther justification for collecting, storing and using this type of personal information. We may process specialcategories ofpersonal information in thefollowing circumstances:

 

1. In limited circumstances, with your explicit written consent.

 

2. Where we need to carry out our legal obligations and in line with our data protection policy.


3. If it is needed in the public interest, such as forequal opportunities monitoring or in relation to ouroccupational pensionscheme, and inline with ourdata protection policy.

 

4. Where it is needed to assess your working capacity on health grounds, subject to appropriate confidentiality safeguards.

 

Less commonly, we may process this type of informationwhere it is needed in relation to legal claims or where it is needed to protectyour interests (or someone else’s interests) and you are not capable of giving your consent, or where youhave already made the information public. We may also process such information about members or formermembers in the course of legitimate businessactivitieswiththe appropriate safeguards.

 

 

 

Our obligations as an engager

 

For employees we may use your particularly sensitive personal information in the following ways:

 

 We may use information relating to leaves of absence, which may include sickness absenceor family related leaves, to comply with employment and otherlaws.

 We may use information about your physical or mental health,or disability status, to ensure your health and safety inthe workplace and to assess your fitness to work, to provide appropriate workplace adjustments, to monitor andmanage sicknessabsence and to administer benefits.

 

Do we need your consent?

 

We do not need your consent if we use special categories of your personal information in accordance with our writtenpolicy to carryout our legal obligations or exercise specific rights. In limited circumstances, we may approach you for your written consent to allow us to process certain particularly sensitive data. If we do so, we will provide you with full details ofthe information that we would like andthe reason we need it, so that you can carefully consider whether youwish to consent. You should be aware that it is not a condition of your contract with us that youagree to any request for consent from us.

 

INFORMATION ABOUT CRIMINAL CONVICTIONS

 

We may only use information relating to criminal convictions where the law allows us to do so. This will usually be where suchprocessing is necessary to carry out our obligationsand provided we do soinline with ourdata protection policy.

 

Less commonly, we may use information relating to criminalconvictions whereit is necessary in relation to legal claims, whereit is necessary to protect your interests (or someone elses interests) and you are not capable of givingyour consent,orwhere you have already made the information public.

 

We do undertake DBS checks and may undertake a DBS checkon you, where required. This includes DBS checks which arerequired under the Baseline Personnel Security Standard (BPSS). If we do so, we will notify you andretain a copy of the DBS results on your file. Where we are required by our client to obtain a DBS check for you, because it is required to confirm your suitability for a role, we will provide a copy of that DBS Check to our client.

 

 

 

AUTOMATED DECISION-MAKING

 

 

Automated decision-making takes place when an electronic system uses personal information to make a decision without human intervention. We are allowed to use automated decision-making in the following circumstances:

 

1. Where we have notified you of the decision and given you 21 days to request a reconsideration.

 

2. Where it is necessary to perform the contract with you and appropriate measures are in place to safeguard your rights.


3. In limited circumstances,with your explicit written consent and where appropriate measures are in place to safeguardyourrights.

 

If we make an automateddecision on the basis of any particularly sensitive personal information, we must have eitheryour explicit written consent or it must be justified in the public interest, andwe must also put in place appropriate measures to safeguard your rights.

 

Youwill not be subject to decisions that will have a significant impact on you based solely on automated decision-making, unless we have alawful basis for doing so and we have notifiedyou.

 

We do not envisage that any decisions will be taken about you using automated means, however we will notify you inwriting if this position changes.

 

DATA SHARING

 

Our HeadOffice, branches and other companies within our Group may share yourdata between themselves.The other companies within the group are Berry Recruitment Limited, Wild Recruitment Limited and Wild Recruitment t/a First Recruitment Services. We will share this data when requiredin order to discharge our obligations to you or to administerourworking relationship withyou. We will not share this data in order to send you marketing materialunless we have obtained your consent to do so.

 

We mayhave to share your data with third parties, including third-party service providers and other entities. We require third partiesto respect the security of your dataand to treat it in accordance with the law.

 

We may transfer your personal information outside the UK or theEEA (European Economic Area). If we do, you can expect a similar degree of protection in respect ofyour personal information.

 

 

 

Why might you share my personal information with third parties?

 

We may share your personal information with thirdparties where required by law, where it is necessary to administer theworkingrelationship with youorwhere we have another legitimate interest in doing so. We will supply or make available your personal data to our clients, where it is required, in order to enable our clients to audit us for the purposes oftheir internal or legalcompliance obligations.

Please note that when using the Berry Recruitment Jobs or BerryWorker app our clients have the ability to see yourlocation data when you have confirmed your departure for a shift and are travelling to a shift.

 

Where you use our online booking service in order to receive our training services(viaBerry Training Services) we willretain your name, e-mail address,national insurance number, date of birth, address,nationality, voice-over preference and details of how you found us. Thisinformation is retained after you have made a booking, for training services, withus.

 

Our online booking system also takes credit and debit card payments. Where you opt to purchase ourservices (viaBerry Training Services) and pay for those services,bydebit or credit card, our online booking system willprocess your personaldata including credit card number, expiry date, CVC and yourpostcode. This data isobtained for the purposes of enabling you to purchase ourservices. The data is not processedorretained by Berry but is immediately transferred securely to athird party online processor called Stripe, which includes Stripe Payments UK Ltd and Stripe Payments Europe Ltd. Their privacy policy can be found at  https://stripe.com/gb/privacy.

 

We use Facebook Pixel, which may automaticallycollect Technical Data about your equipment, browsing actions andpatterns, including yourIPaddress.


How secure is my information with third-party service providers and other entities in our group?

 

All our third-party service providers and other entities are required to take appropriate security measures to protect yourpersonal information in line with our policies. We do not allow our third-party service providers to use your personal datafortheir own purposes. We only permit them to process your personal data for specifiedpurposes and in accordance with our instructions.

 

What about other third parties?

 

We may share your personal information with other third parties, for example in the contextof the possible sale or restructuring of the business. We may also need to share your personal information with a regulator or to otherwise complywith the law.

 

Please note that the managedservice providers and clients we engage may work withlocal councils,public bodies,and other public and private sector organisations that work with the CabinetOffice to detect and prevent fraud as part of the NationalFraud Initiative (NFI):  https://www.gov.uk/government/publications/fair-processing-national-fraud- initiative/fair-processing-level-3-full-text.

 

The Cabinet Office will carry out a data matching exercise on botha national and local level, withthe assistance fromother government department branches,public bodies, and private sector organisations to collect and audit records withaims to detect and prevent fraud.As a result, yourpersonalinformation may be sharedunder this initiative.

 

Data sharing for thispurpose will not require your consent, as the use of personal data for thisinitiative will be carried out in accordance with Part 6 of the Local Auditand Accountability Act 2014 and Article14 of the Retained Regulation (EU)2016/679 (UK GDPR). The data matching exercise will also be subject to the Cabinet Office’s Code of Data Matching Practice: https://www.gov.uk/government/publications/code-of-data-matching-practice-for-national-fraud-initiative.

 

DATA SECURITY

 

We have put in place measures to protect the security of your information. Details of these measures are available uponrequest.

 

Third partieswill only process your personalinformation on ourinstructions andwhere they have agreed to treatthe information confidentially and to keepitsecure.

 

 

 

We have put in place appropriate security measures to prevent your personal information from being accidentally lost,used or accessedin an unauthorised way, altered or disclosed. Inaddition, we limit access to your personal informationto those employees, agents,contractors and other third parties who have a business need to know. They will only processyour personal informationonour instructions and they are subject to a duty of confidentiality. Details of these measuresmaybe obtained from Chris Chown (chris.chown@berryrecruitment.co.uk) (Data Protection Manager).

 

We have put in place procedures to deal with any suspecteddata security breach and will notify you andanyapplicable regulator of a suspected breach where we are legally required to do so.

 

DATA RETENTION

 

How long will you use my information for?

 

We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes ofsatisfying any legal, accounting, or reporting requirements.Details ofretention periods for different aspects of your personal information are available in our retention policy which is available from Chris Chown (chris.chown@berryrecruitment.co.uk). To determine the appropriate retention period for personal data, we consider theamount, nature, and sensitivity of the personal data, the potentialrisk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through


other means, and the applicable legal requirements. Ordinarily, we anticipate that we will retain your data for 6 years afterthe financial year that we last process yourPersonaldata. i.e. from the date that you last work for us.

 

In some circumstances we mayanonymise your personal information so that it can no longer be associated with you, inwhich case we may use such information without further notice to you. Once you are no longer an employee, worker orsubcontractor of the company we will retain and securely destroy your personal information in accordance with applicable laws and regulations.

 

When using the Berry Recruitment Jobs Appyour location data will be retained as follows:-

 

The location data sent to us every 5minutes when travelling to and attending a shift is deleted 4 weeks afteryou havecompleteda shift.

 

The location data relating to clock-in / clock-out of a shift is retained for 6 months aftera shift completes, allowing enoughtimeto resolve any duration of shift queries with ourclients.

RIGHTS OF ACCESS, CORRECTION, ERASURE, AND RESTRICTIONYour duty to inform us of changes

 

It is important that the personal informationwe hold about you is accurate and current. Please keep us informed ifyourpersonal information changes during the period you provide servicestous.

 

Your rights in connection with personalinformation

 

Under certain circumstances, by law you have the right to:

 

•             Request access to your personal information (commonly known as a data subject access request). This enablesyou to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.

 

•             Request correction of the personal information that we hold about you. This enables you to have any incompleteor inaccurate information we hold about you corrected.

 

•             Request erasure of your personal information. This enables you to ask us to delete or remove personal informationwhere there is no good reason for us continuing to process it. You also have the right to ask us to delete or removeyourpersonal information where you have exercised your right to object to processing (see below).

 

•             Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processingon this ground. You also have the right to object where we are processing your personal information for direct marketingpurposes.

 

•             Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of personal information about you, for example if you want us to establish its accuracy or the reason forprocessing it.

 

•            Request the transfer of your personal information to another party.

 

If you want to review, verify, correct or request erasure of your personal information, object to the processingof your personal data, or request that we transfer a copy of your personal information to another party, please contact Chris Chown(chris.chown@berryrecruitment.co.uk) in writing.


No fee usually required

 

You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request for access is clearly unfounded or excessive. Alternatively, we may refuse to comply with the request in such circumstances.

 

What we may need from you

 

We mayneed to request specific information from you to help us confirm your identity and ensure your right to access theinformation (or to exerciseany of your other rights). This is another appropriate security measure to ensure that personal information isnotdisclosed to any person who has no right to receive it.

 

 

 

RIGHT TO WITHDRAW CONSENT

 

In the limited circumstances where you may have provided your consent to the collection, processing and transfer of your personal information for a specific purpose, you have the right to withdraw your consent for that specific processing at any time. To withdraw your consent, please contact Chris Chown. Once we have received notification that you have withdrawnyour consent, we will no longer process your information for the purpose or purposes you originally agreed to, unless we have another legitimate basis for doing so inlaw.

CHANGES TO THIS PRIVACY NOTICE

 

We reserve theright to update this privacy notice at any time, and we willprovide you with anew privacy notice whenwemake any substantial updates. We may also notify you in other ways fromtime to time about the processing of yourpersonal information.
